Ashland University Copyright Policy

We comply with the Digital Millennium Copyright Act (DMCA). 

The Digital Millennium Copyright Act lays out a system of legal requirements for dealing with allegations of copyright infringement.

Notice of Claimed Infringement

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Our Designated Copyright Agent (identified below) with the following information:

(a)     an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;

(b)     description of the copyrighted work or other intellectual property that you claim has been infringed;

(c)     a description of where the material that you claim is infringing is located on the SITE (preferably including specific url’s associated with the material);

(d)     your address, telephone number, and email address;

(e)     a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and,

(f)     a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.

AU Publication Policy 

All publications produced through Graphic Arts Services will follow their normal flow until the final proof stage. Once Graphic Arts receive the final proof, the job will be reviewed by the Marketing & Communications Department. If any major changes need to be made, the person responsible for the job will be contacted. However, this is not anticipated and this extra proofing is being done only to provide a safeguard to catch typos or errors in factual information. All jobs going to off-campus constituents or prospective students will require the approval of the Marketing & Communications Department before printing.

A number of offices are now printing their own brochures.. It should be noted that brochures designed and/or printed by individual offices and being mailed off campus or given to prospective students must also be approved by the Marketing & Communications Department.

In addition, those publications not typeset by Graphic Arts Services but scheduled to be printed by the AU Print Shop will require the approval of the Marketing & Communications Department before the completion of the job. Jobs produced or printed off campus must follow the same guidelines as those on campus.

This policy allows the University to maintain a consistent voice in its marketing and brand identity.

Using the University’s Name

An independent student group may make use of the University’s name in its title, publications or letterhead, but may not use the name in a manner that in any way would constitute an endorsement, approval or underwriting of any organization, product, activity, service, or contract by Ashland University.

            AU College Republicans

            Ashland University College Republicans

As a general rule, the University’s name cannot precede the name of the organization.

Affiliated groups of Ashland University Student Activities and Student Government may use the University’s name preceding that of their group. For example, Ashland University Community Care. This permission extends to club sports organized under the program control of the University.

Using the University’s Marks

Individual students and/or student organizations are prohibited from using the University seal or logos or letterheads, business cards, or other identifying materials. Such student organizations may receive permission from the Department of Public Relations to utilize a University mark for a special event when the University co-sponsors the event.

Royalties

 All products or services bearing the University’s name and/or logos must be purchased from or contracted with licensed companies and will be assessed a royalty fee. Purchases by student organizations and club sports for resale to members (even if goods are sold at cost) are not exempt from royalties.

Ashland University Bookstore is responsible for filing all Trademark and Service Mark applications including all application fees. Any indicia adopted hereinafter and used or approved by the University shall be deemed to be addition to the indicia as though shown here and shall be subject to approval by Ashland University.

Products

Ashland University is interested in preserving its reputation. Goods and products that bear our mark(s) must reflect a positive image of AU. Ashland University will approve for licensure those products that promote the university mission. Products submitted for licensing can and will be rejected for at minimum the following reasons: poor quality, poor taste, risk of harm or injury from product, heat transfers, and embroidered patches. The university reserves the right to expand or reduce this list at its own discretion.

It is recommended that the AU Bookstore host a product review committee composed of the relevant department members, faculty, and students. This committee could help establish a list of known acceptable and unacceptable products. Such a list would assist in the protection of the reputation of the institution and also prevent it from potentially unfavorable publicity and legal action.

Campus and Support Group Use

Anyone properly affiliated with the University may be permitted to use the institutions name and trademark to identify themselves as students, faculty members, or alumni of the school. Since a licensing program is concerned with the use of the trademark on commercial products, it is reasonable for other uses of the University’s marks to continue outside the purview of the licensing program. The Athletic Department is the best example of a campus organization that has a right to use the school’s name on garments without reference to licensing or trademarks, as long as such products are for use by the coaches, athletes, and officials. However, should any campus organization, including the Athletic Department or Alumni Association, want to sell these products, even to others on the campus as a fundraiser, they are required to obtain these products from a licensed company.

All vendors that will be reproducing a University mark should be registered, using a simple agreement. This agreement indicates that the vendor will only make and sell emblematic merchandise to properly affiliated departments for non-commercial purposes.

Non-commercial use of the University’s names by registered affiliated organizations and by recognized support groups such as athletic, cultural, and other interest groups is permitted. Use of the University’s name by other independent organizations and groups is prohibited.

Employees may not use the University’s names, or their affiliation with the University in any manner which suggests or implies University support or endorsement of any movement, activity, or program. In circumstances where there is potential for University endorsement or support to be consumed from an individual’s use, a disclaimer is required.

All commercial use of the University names and trademarks, including the manufacture and distribution of all commercial and consumer products (e.g., clothing, souvenir items, gifts, printed matter, and other emblematic merchandise), or services bearing the University’s trademarks, is permitted only by license or authorized products must be distributed through the campus bookstore or by authorized licensees.
